By using our services you are acknowledging that you have read, understood, and agreed without limitation or qualification, to be bound to these Terms and Conditions. Please read the Terms & Conditions given below extremely carefully as it contains very important information

Please note we have the right to change the terms and condition when we see fit, please make sure you read through them from time to time. These terms and conditions do not affect your statutory rights.

Formation of Contract

Any order sent to the Seller by the Buyer shall be accepted entirely at the Sellers discretion. Each order which is so accepted shall constitute an individually legally binding contract between the seller and the buyer which shall incorporate the conditions.  This shall be henceforth known or referred to as an ‘order’.  These conditions shall override any contrary different or additional terms or conditions (if any) contained or referred to in an order form or other documents.  No alteration or addition, of these terms will be blind from the Seller, unless they are accepted in writing by a person authorised to sign on behalf of the Seller.

Prices 

The prices displayed on our website are all inclusive of VAT at the current rate. Prices in your online shopping basket are also displayed inclusive of VAT. 

Please note we try our best to keep all prices up to date,  however errors can sometimes occur. If we come across a pricing error when processing your order, we will contact and advise you of the correct price. We will then give you the option of whether you would like to progress or cancel the order. If you are happy go ahead with the order we will then ask you for the additional payment.

All prices are British Pounds (GBP) and all payments and refunded will conducted in this currency

Product Descriptions

Although we aim to keep the product information as up to date as possible, the information including product descriptions appearing at any one time may not reflect the product at the moment you place the order. Any weights or dimensions given about the goods are approximate only.

Stock Availability

Please be sure to contact us regarding stock availability.  We do try to keep our stock as accurate as possible; all our items placed on order are subject to availability. If the goods you have ordered are unavailable for any reason you will be informed straight away and given a new delivery date.

The buyer will be able to correct any details entered up until the point of entering your payment detail and submitting your order. The Seller will send The Buyer a confirmation email of the details of the order to the e-mail address given.  Please read the email carefully if you notice any discrepancy’s on the order, please contact us immediately to the correct them.

Payment Terms 

You may pay using any of the methods specified such as debit/credit card, PayPal, clear pay or Klarna.

When paying by credit/debit card you confirm that the credit or debit card that is being used is yours. Your credit/debit card will be charged for the full payment once you have placed  your order. If the issuer of your payment card refuses or does not, for any reason, authorise payment to us, whether in advance or subsequent to a payment, we will not be liable. Furthermore we may cancel the contract and or suspend further deliveries to you.

Please be aware occasionally we may need to contact you to confirm some extra details regarding your order as part of fraud checks. The Little Nut Tree takes Fraudulent Offences very seriously and take actions on any order that seem fraudulent. If we believe an order to be fraudulent we will cancel the order and refund you in full without notice.

You will be reimbursed in full, in the unlikely event that someone uses your card fraudulently on our website.  Appropriate Evidence will be required to prove that the transaction is fraudulent.

Delivery 

We will deliver the goods in accordance with the delivery option selected by you during the order process. Any delivery timescales quoted to you are indicative only. If it is not possible to meet the timescale quoted we will contact you using the information provided on your order.  Orders may be delivered in one or more parts. We do not accept any liability whatsoever for delayed delivery caused by any third party or for delays because you did not give us the correct contact, delivery or payments details.

Please make sure the delivery address specified on your order is accurate as this is where your goods will be delivered. Please leave us precise delivery instructions about where to leave your goods if you may be out when they are delivered. We will not be held liable for any loss or damaged goods once they have been delivered in accordance with your delivery instructions.  

Damage in Transit

The Little Nut Tree will happily replace free of charge any goods proved to the Seller’s satisfaction to have been damaged in transit. The Buyer has 24 hours from once the goods have been delivered to notify us the Seller in writing of the occurrence of the damage and also, if and so far as practicable, of its nature and extent.

Risk and Ownership 

You will only take ownership of the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied from The Seller to The Buyer are not for resale. Risk of loss of goods passes to you at the time of delivery.

Acceptance of Order 

You will be required to provide us with your e-mail address as to which we will notify you by e-mail as soon as possible to confirm receipt of your order also to confirm details, please note this confirmation is only an acknowledgement of the details of your offer to purchase goods. Once your goods have been dispatched an acceptance order will then take place.

Cancellation 

Under the Distance Selling Regulations you have the right to cancel your order within seven days of receipt of goods (with the exception of any made to measure or bespoke items). If you wish to cancel your order please contact us immediately.

The Little Nut Tree owes all right to this website including copyright. All rights are reserved.

If you wish you can save print or download any images info text from the site for non-commercial use only. Images Info Text etc. may not be used for reproduction in any circumstances. Prior consent must be given before you use, reproduce, repost, copy, modify or otherwise exploit anything from this website.

Great care has been taken to ensure our website is free from viruses or defect and is extremely safe to use. We can ensure that using this website will not cause damage to your monitor or hard drive.

Applicable Law

The Order placed will create legally binding contract made in England and shall be governed in respect by the Law England and the parties agree to submit to the non-exclusive jurisdiction of the English Courts.
